All Hell Is Breaking Loose (Crypto CLARITY Act)
Passing clarity actually creates rules of the road that are in the best interest of the American financial system. I think they will resolve this ethics issue and they'll pass the bill. The world is passing us by.
As far as I've heard, they've still not solved the problem of corruption, of consumer protection, of national security, or protecting our economy. Crypto Clarity Act conversations are heating up in the Senate. The fate of crypto in the United States is being debated as we speak. In this clip, two titans, Democratic senator from Maryland, Chris Van Holen, debates Kenneth E. Benson Jr., who is the president and CEO of SIFFMA.
You can pretty much guess who's for crypto in this clip and who's against crypto. The fate of the crypto industry in the United States is being discussed now.
That seems like common sense to make sure we protect uh a level playing field. The challenge we have right here is the Clarity Act, which is proposed legislation before the Senate has the same problem. Here's how a Wall Street Journal editorial board put it on Tuesday. And um no left-wing outlet, the Wall Street Journal, and I'm just putting up the headline, clarity for crypto, sort of. And then they say the Senate bill to regulate the digital currency needs changes to reduce risks to the financial system.
And I think this is a warning for all of us that that bill is not ready for prime time. They say right now that in if you if you read it, you'll find that the argument is that it will migrate to shadow markets. More investments will migrate to shadow markets with few or no investor protections. Um you you would agree that that would be a concern, would you not?
Uh yes. Uh, Senator, so if I could say two things. Um, one is we have long said, I've long said Congress should act in this space. So, so good for Congress to be acting. Um, we think the bill that came out of the Senate Banking Committee, uh, had a number of good things in it, uh, where there were clarifications that needed to be made, things like bank permissibility, portfolio netting. um but in trying to address some of the concerns around what rules apply to DeFi when you when you determine between a programmer computer programmer versus somebody's actually in the business.
So that's good. When the bill got to the ad committee some of those things didn't carry over and so we do have concerns with the bill as we understand it today but we haven't quite seen it so we don't really know but we do think that it is important for Congress to set the rules.

So, with seemingly less than 24 hours to go to get this Clarity Act on the Senate floor, Senator Elizabeth Warren gleefully alerts the media that in her mind there's just too many problems to get the Clarity Act on the floor before the August recess.
Are you concerned that this bill could come up before you all leave for August recess and that it might pass? Or are you hearing from your colleagues that there's just no appetite in the Senate? As far as I've heard, they've still not solved the problem of corruption, of consumer protection, of national security, or protecting our economy. And until you solve those problems, I just don't see how anyone, Democrat or Republican, moves forward on this bill.
However, this was an interesting development. Senator Banking Chair Tim Scott, he is in the room where the negotiations are happening. He's telling Fox Business that the Clarity Act will pass before the August recess will get it done because according to him, they're going to stay longer than just the next day or two. Recess is secondary to getting the crypto bill passed.
You have been working on this bill. The Senate has been working on this bill for over a year. Do you believe it can get across the finish line this week before you leave, or is this something to attack when you're back? No, ma'am. This is something we should have the first vote before we leave without any question. John Zun has an opportunity to te it up for a vote before we leave. And frankly, we'll be here longer than just the next two days.
We might be here much longer. So, the good news is we have the time to get it done. This is in the best interest of protecting consumers and allowing innovation to happen here in America. Really important time for us. We'll get it done. Republicans are coalescing and that's great news. That'll bring Democrats along.
However, on Kulshi, the odds of the Senate voting on Clarity Act before the August recess are plummeting now less than 5%. We really are getting conflicting information as it seems insiders just can't agree whether Clarity Act has a chance of passing before recess. Now, ex New York Governor Andrew Cuomo says he believes that the cryptoclarity act issues will be resolved. it will get passed. He thinks ethics was the biggest issue holding clarity up.
However, each side has made concessions. Democrats and Republicans should come together. He says it's just common sense to pass this. I think they will resolve this ethics issue and they'll pass the bill. And again, the world is passing us by. I've been involved in crypto actually when I was governor 2014. uh we put together the first regulations for crypto. We wanted them to come to New York. I was excited by the technology, you know, with crypto, put all the tokens, etc. aside and the coins.
The technology is groundbreaking and I believe that doesn't go back in the bottle and that can transform the financial system. So 2014, New York put regulations in in place. We're still waiting for the federal government to provide clarity, pardon the pun, by passing the Clarity Act. Uh meanwhile, we see Europe uh is going gang busters. They got 30 countries to agree on uh crypto regulation and we can't get the uh House and the Senate to agree.
So, is this where do you think the state of uh the state of these negotiations really stand? Yeah, we need well clarity is a great name for a bill because it actually describes it. We need clarity. Tell me the rules, right? Uh I want to play the game fairly, but you have to tell me the boundaries. Uh and that's what the Clarity Act is all about. I think they've worked through a lot of the substantive issues. They're basically now dealing with this ethics provision which is highly political where uh the Democrats want to limit the president's ability to make money from crypto and obviously they're referring back to uh the amount of money he made uh and family connections in crypto and they want to raise that in the campaign.
Uh I think Republicans want to see that issue go away in the campaign. I think they will resolve this ethics issue and they'll pass the bill. And again, the world is passing us by. Uh, OKX, we're going gang busters in Europe and they're passing regulations and the technology is flourishing. When you pass the regulations, uh, and you allow innovation to develop, uh, it takes off. And that's what's happening around the world. ex and it's not happening here in the US because of the clarity act.
